Have You Bought Babyganics Products? You Could Be Eligble for Settlement Money

Hey mamas of babies, are you eligible for the Babyganics settlement? A class-action lawsuit against one of the most popular baby brands was recently settled, and it’s possible that you may be due a piece of it. Representatives from Babyganics did not immediately respond to Red Tricycle’s request for comment.

Back in 2016, consumers in New York and California filed a class-action lawsuit against KAS Direct LLC, the maker of Babyganics. The suit alleged that the company used deceptive marketing and business practices when promoting its Babyganics products.

The suit alleges that Babyganics’ products were made to seem as though they were all organic, even though they weren’t—specifically, that some of the language they used (such as “mineral-based” and “natural”) violated marketing and sales laws.

According to reports, the company settled the suit to avoid future litigation but denies the claims. The Babyganics website provides consumers with a detailed description of their ingredient selection process, which reads: “We always start with plant-based and plant-derived ingredients, organic when practical, as well as carefully chosen synthetics or preservatives needed to create the kind of formulas that work effectively and that parents can feel good about using around their babies.”

So how do you know if you’re eligible to be part of this class-action lawsuit claim? Anyone who purchased Babyganics products between Sep. 7, 2010 and Jun. 26, 2018 may be eligible. You’ll need to submit a claim by Oct. 29, 2018 to receive any payment. You can find the form, as well as more information, at www.babyganicssettlement.com or by calling 1-888-332-0279.

Just a heads-up: if you legitimately feel that you deserve a payment as a result of this lawsuit, filing a claim now means you lose the ability to bring any legal action against the makers of Babyganics in the future.

But if you bought Babyganics products during the time the lawsuit includes and don’t feel that they’re in the wrong or that you have been deceived, this isn’t a way to make back some of the money you spent. (Seriously.) You can exclude yourself from the suit or simply do nothing.
